What kind of Bankruptcy should you take?

Chapter 7 and Chapter 13 are the two most common bankruptcies for consumers.

In a Chapter 7, you are discharged from all your debts, except non-dischargeable debts such as taxes less than three years old, and student loans. Further you are required to continue paying secured debt unless you wish to surrender the collateral, such as a house or car.

A Chapter 13 may be your best option if your income is sufficient for you to make monthly payments to the Court. If you have fallen behind on home or car loan payments, needing time to catch up, or if you have more property than what the Court allows you to keep in a Chapter 7 bankruptcy, you may pay all your debts in affordable monthly payments for a period of 3 to 5 years.
